‘Ghost Gun’ with 30-round magazine seized in Utica

UTICA, N.Y. (WUTR/WFXV/WPNY) – The Utica Police Department is reporting that a man is Utica has been arrested for possession of an illegal handgun with an extended 30-round magazine.

Around 9:00 on September 27th, the Crime Prevention Unit was conducting a proactive GIVE gun suppression detail motor vehicle stop on Square St near Johnson Park. During the stop Officers noticed a man in the back passenger seat of the vehicle who was behaving suspiciously and making attempts conceal his movements from them. 

The man, later identified as 28-year-old David Cruz Hernandez of Utica, then attempted to kick a small bag underneath the seat in front of him. These actions were enough to give the police reasonable suspicion and had Hernandez exit the vehicle for a more thorough search.

While conducting the search of the vehicle, Officers located the small bag and found a loaded 9mm “ghost gun”, which is a gun that has had the serial number removed so that it cannot be identified, with 21 rounds in a 30-round extended magazine. It was that this point, that police detained all the occupants and transported them to the Utica Police Department to further the investigation.

After the investigation ended, David Cruz Hernandez was charged with the following:

  • Criminal Possession of a Weapon 2nd
  • Criminal Possession of a Firearm
