Eminent Domain for Proposed Utica Hospital?


With Mohawk Valley Health System in the process of acquiring properties within the proposed hospital footprint, and some property owners saying they will not sell, eminent domain may be the final step to acquire all properties. The City of Utica would handle the properties inside the footprint of the proposed hospital, and Oneida County would handle properties in the proposed parking garage area. Attorney Richard James says before the last few decades, eminent domain cases generally did not involve acquisition of blighted properties. MVHS listed multiple properties inside the footprint as “blighted,” in their Final Environmental Impact Statement. Eyewitness News reporter Ben Dennis has the story.
