Brandon Clark, the man who had pleaded guilty to murdering Bianca Devins, has had a new attorney appointed to handle his request to withdraw that plea. Wednesday morning, Oneida County Judge Michael Dwyer assigned attorney Gregg Starczewski to serve as Clark’s counsel as he seeks to get his guilty plea withdrawn.
Clark was scheduled to be sentenced last month, but on the scheduled date Clark asked Judge Dwyer to have his defense lawyer removed and replaced and to have Clark’s guilty plea withdrawn. Clark told Judge Dwyer that he felt that he did not get adequate representation when making his plea in February.
Judge Dwyer did not act directly on Clark’s request to change his plea. After appointing Starczewski to represent Clark, Dwyer set September 14, 2020 to hear the motion to withdraw the guilty plea, September 22nd will be the date for the prosecution’s response to he motion and then a hearing on the motion on September 30th.
