The “No Hospital Downtown” movement has filed a lawsuit against the Utica Planning Board, Mohawk Valley Health System, The New York State Office Of Parks, Recreation and Historic Preservation, and the Dormitory Authority of the State of New York. Cofounders Jim Brock and Brett Truett, along with five other petitioners, filed the suit in Albany County. Brock believes the findings throughout the State Environmental Quality Review Process do not properly address potential traffic going in and out of downtown, among other concerns. Brock says the group filed the suit in Albany County because he believes proponents of a downtown hospital could possibly sway the opinion of local Supreme Court judges, and becuase two defendents listed in the lawsuit are based in Albany.
